Legal Representation for Buyers

While it is not required that a homeowner retain legal counsel, it is to your benefit to do so. An attorney will review the proposed contract of sale and make any additions, deletions or modifications to protect your best interests. Once attorney review is over, an attorney will act as a facilitator in getting a transaction to closing by ordering titlework and a survey, and following up on contingencies in the contract, such as the Home Inspection, Additional Deposits Due and the Buyer's Mortgage Commitment. Finally, an attorney will act as the settlement agent, disbursing funds at the closing table.

Keep in mind that in the State of New Jersey, Realtors draw up contracts for sale of residential property; once a contract offer has been signed by both the Buyer and Seller, an attorney has a 3-day review period to modify the contract. So while it is not necessary to obtain a lawyer ahead of time, it is wise to contact one quickly after you sign a contract.
